Please join us for a briefing by the Office of the Maryland Attorney General on how to
respond to demands for information pursuant to CALEA, the Patriot Act, FERPA, DMCA,
Maryland's Public Information Act, the new federal E-Discovery Rules, and a few other
statutes.
Various statutes give state and federal agencies, students, plaintiffs, and the general
public the right to view and/or copy the University's records under certain circumstances.
Failure to adequately recognize these obligations and respond appropriately and timely
can result in sanctions levied against the University and, in some cases, against the
individual custodian of the records. Because so many records are now stored
electronically, the University relies on its IT department to retrieve and organize
these records. This presentation will briefly summarize the obligations imposed by
a variety of statutes, provide examples of the kinds of requests you might encounter,
and offer practical tips on responding appropriately.
Presenters: Carolyn Skolnik, an Assistant Attorney General in the Maryland Attorney
General's Educational Affairs Division, and Thomas Faulk, Deputy Chief of that Division,
will be the presenters. Each of them has represented various institutions of higher
education in Maryland for more than thirteen years, and both have significant experience
advising institutions faced with voluminous requests for information. They guarantee
a fun-filled and lively presentation. CORRECTION: Actually, they don't guarantee
anything, especially fun, because, let's face it, they'll be talking about electronic
information retrieval. They do hope you'll find it informative and helpful.
